Terms and Conditions of Hire and Sale

 

1. Parties

 

These Terms and Conditions constitute a contract between WJW Scaffolding Hire & Sales (“the Owner”) and the customer (“the Hirer” or “the Buyer”), governing the hire and/or sale of scaffolding equipment.

 

2. Exclusion of Other Terms

 

All terms of the contract between the Owner and the Hirer/Buyer are contained within this document. No other condition or warranty shall be implied or deemed to be incorporated unless expressly agreed in writing by the Owner.

 

3. Agreement for Hire

 

The Owner agrees to hire, and the Hirer agrees to take on hire, the scaffolding equipment specified in the quotation or delivery note, subject to these Terms and Conditions.

 

4. Hire Period

• The standard hire period is 6 weeks from the date of scaffold completion, unless otherwise stated in the quotation.

• After the initial hire period, additional hire charges will apply at 7.5% of the total hire price per week, until the equipment is returned or the Owner is notified in writing that the equipment is ready for collection.

• The Hirer must provide no less than five (5) clear days’ notice to the Owner for the removal of scaffolding before the expiry of the hire period. Early removal does not entitle the Hirer to a reduction in the hire charges.

 

5. Suitability and Intended Use

 

The Owner is not aware of the intended use of the hired or purchased equipment and, therefore, cannot guarantee its suitability for any specific purpose. It is the sole responsibility of the Hirer/Buyer to ensure that the equipment meets their requirements.

 

6. Condition of Equipment

• The Hirer/Buyer acknowledges that they have inspected the equipment and found it to be in good condition and suitable for their purposes at the time of hire or purchase.

• The Owner shall not be liable for any loss or damage arising from the use of the equipment, including any indirect or consequential loss.

 

7. Ownership

• All hired equipment remains the property of the Owner at all times.

• Title to sold equipment passes to the Buyer only upon full payment of the purchase price.

 

8. Loss or Damage

• The Hirer is responsible for any loss or damage to the equipment during the hire period.

• The Hirer shall indemnify the Owner for the cost of repair or replacement of any lost or damaged equipment, excluding fair wear and tear.

 

9. Returns and Refunds

No refunds will be accepted on any sales of scaffolding equipment.

• Hired equipment must be returned in the same condition as received, excluding fair wear and tear. Charges may apply for cleaning, repair, or replacement of damaged items.

 

10. Payment Terms

• Payment terms will be as specified in the quotation or invoice.

• The Owner reserves the right to charge interest on overdue accounts at the statutory rate.

 

11. Termination

• The Owner may terminate the hire agreement immediately if the Hirer breaches any of these Terms and Conditions.

• Upon termination, the Hirer must return all hired equipment to the Owner without delay.

 

12. Governing Law

 

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
